Privacy Policy
What personal information we collect when you use AvenQuant, why we collect it, who sees it, how long we keep it and what your rights are.
Definitions
Personal data
Information about an identified or reasonably identifiable individual, such as your name, email address and phone number. Australian law calls this "personal information".
Usage data
Technical information collected automatically when you use the site, such as your IP address, browser type, pages visited and time spent.
Cookies
Small files stored on your device that help a site remember your settings and understand how it is used.
Data controller and processor
The controller decides why and how personal data is used. For this site that is [LEGAL ENTITY NAME], trading as AvenQuant, contactable at [email protected] and at Level 12, 45 Clarence Street, Sydney NSW 2000, Australia. A processor handles data on our behalf and on our instructions.
Collection and use of information
When you register, ask for a call or contact us, we collect the details you give us: your first name, last name, phone number, email address and the content of your request. If you go on to open a trading account we also collect the identity information described on the AML / KYC page. We collect usage data and cookie data automatically.
We use it to respond to your enquiries, to provide and support the services you ask for, to meet our legal obligations, to keep the service secure, to understand how the website is used and to improve it. With your agreement, we also use it to send you marketing.
Legal basis
We handle your personal information in line with the Privacy Act 1988 and the Australian Privacy Principles. In broad terms, we do so because it is needed to provide the service you asked for, because the law requires it, because we have a legitimate interest in running a secure and effective business that is not outweighed by your rights, or because you have consented. Marketing is always based on your separate consent, which you can withdraw at any time. Where a visitor is in the European Economic Area or the United Kingdom, we also respect the additional rights that local law gives them.
Data retention
Enquiry details are kept while we deal with your request and for a reasonable period afterwards. Account and verification records are kept for as long as your account is open and for the period the law requires after it closes, which for financial crime records is at least seven years. Marketing data is kept until you unsubscribe. Usage data is kept in aggregated form for as long as it is useful. When information is no longer needed, we delete or de-identify it.
Transfer of data
Some of our suppliers, such as cloud hosts and verification providers, may process data outside Australia. Where that happens, we take reasonable steps to make sure the recipient protects your information to a standard consistent with Australian law, usually through contract terms.
Disclosure of data
We may share personal information with the licensed entity that provides your trading account, with affiliated companies, with IT and hosting providers, with identity verification services and with regulators and law enforcement where the law requires it. We may also share it in the event of a sale or restructure of the business, and we do not sell personal information.
Security
We protect personal information with encryption, access controls and staff training, and we monitor our systems for unauthorised access. No method of storage or transmission is completely secure, so we cannot promise absolute security. Details of account protections are on the Security page.
Your rights
You can ask to see the personal information we hold about you, to have it corrected if it is wrong, to have it deleted where we are not required to keep it, to restrict or object to particular uses and to withdraw consent to marketing. Write to [email protected]. We may need to confirm your identity first, and we will respond within a reasonable time, usually 30 days.
If you think we have mishandled your information, you can complain to us under the complaints procedure. If you are not satisfied, you can contact the Office of the Australian Information Commissioner (OAIC).
Service providers
We use third parties to host our systems, verify identity, send email, provide support software and process payments. They may access personal information only to perform those tasks for us and are contractually bound to protect it and not to use it for their own purposes.
Analytics
We may use analytics tools, such as Google Analytics, to understand how visitors use the site. These tools set cookies and receive usage data. You can limit them through your browser settings or a cookie management tool.
Advertising and retargeting
If we run online advertising, advertising partners may use cookies to show you our ads on other sites or to measure their effect. You can opt out through your browser and through the advertising platforms' own settings.
Links to other sites
Our website may link to sites we do not operate. This policy does not apply to them, and we encourage you to read their privacy policies before you give them any information.
Children's privacy
The site and its services are for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, tell us and we will delete it.
Changes to this policy
We may update this policy from time to time. The current version, with its date, is always on this page, and if a change is significant we will tell you in an appropriate way.
